The U.S. Supreme Court on Monday declined to hear CSX's bid to revive its antitrust lawsuit that accused Norfolk Southern Railway of illegally restricting access to Norfolk International Terminals in Virginia, Reuters reported.

In 2018, CSX sued NS in federal court in Virginia, accusing NS of conspiring with Norfolk & Portsmouth Belt Line Railroad to set an excessive fee for services at the East Coast terminal.

CSX in a statement on Monday expressed disappointment in the Supreme Court's decision not to take up the appeal but said the company is committed to ongoing efforts at a U.S. regulatory agency to secure what it called competitive rail access at the Norfolk terminal, according to Reuters.

NS said in a statement that the court put an end to what the company called a "lengthy, frivolous and meritless action," Reuters reported.
