STB issues five railroad-related rulings at open voting conference

Last week, the Surface Transportation Board handed out several decisions at an open voting conference in Washington, D.C.

The board determined that:
• after making minor adjustments to a March 2003 decision, Burlington Northern Santa Fe's rates challenged by the Texas Municipal Power Agency remain "unreasonably high," and require the STB to prescribe maximum reasonable rates and order a recalculation of reparations;
• Milford-Bennington Railroad Co. and Granite State Concrete Co. Inc. did not prove that Boston and Maine Corp. and Springfield Terminal Railway
Co. unreasonably interfered with Milford-Bennington's transportation
• a pertinent tariff permits the owner of a rail car's reporting marks to assign the right to receive mileage-allowance payments to the car's lessee;
• Ohio Valley Railroad Co. can acquire and operate certain trackage in
Evansville, Ind., and Indiana Southwestern Railway Co.'s petition to revoke Ohio Valley's exemption notice is denied; and
• Peoria Heights and Western Railroad can build 1,800 feet of
connecting track in Peoria, Ill., on land it owns.
