STB seeks public comments on proposed solid-waste transfer facility rulemaking

Yesterday, the Surface Transportation Board (STB) announced it issued a notice of proposed rulemaking and is accepting comments on proposed rules to govern the implementation of The Clean Railroads Act of 2008.

The proposed rules, which cover solid-waste rail transfer facilities, would serve as interim requirements until the board completes its rulemaking proceeding.

Enacted in October, the Clean Railroads Act adds new sections to Title 49 of U.S. Code to limit the STB’s authority over solid-waste rail transfer facilities and expand states’ authority to regulate the facilities.  The proposed rules stipulate what existing and proposed solid-waste rail transfer facilities must do to comply with the law, the STB’s role under the act and the law’s other effects.

The STB will accept comments until Feb. 23; reply comments must be filed by March 23.
